PDR Junction is owned by Thinkulus Media, LLC., who publishes the following Terms of Service.

Privacy Policy

Your privacy is of the utmost importance to Thinkulus Media, LLC. Because we ask for some basic personal information during registration as a PDR Junction PDR Insider, we want you to be fully informed of how this information is gathered and used.

PDR Insider Registration

    • Email Address – Thinkulus Media, LLC will never sell, trade, give away, or abuse your email address in any way.  Your email address is used to validate that you are a real person and to communicate important messages to you regarding your PDR Junction account.
    • User Name – This is how you are identified when you log in and when you make comments at PDR Junction.
    • Your First and Last Names – These are not required to register as a PDR Insider.

Directory of PDR Providers Registration

    • Email Address – By entering your email address into the Directory Submission Form, you give Thinkulus Media, LLC permission to post that address in the Directory Listings.  The address will not appear directly, but will be hyperlinked behind the word “Email” in the listings.  If you do not wish to have your email address published, you should leave this field blank.
    • Business Name – By entering a business name into the Directory Submission Form, you give Thinkulus Media, LLC permission to post that name in the Directory Listings.  You also certify that you are authorized to list that business name.
    • Your First and Last Names – Your first and last names will only be published in the Directory Listings if you list them as your “business name”.  Fields for first and last name exist in the Directory Submission Form solely for the purpose of providing Thinkulus Media, LLC with a contact name for correspondence purposes.
    • Website Address – By entering your website address into the Directory Submission Form, you give Thinkulus Media, LLC permission to post that address in the Directory Listings.  The address will not appear directly, but will be hyperlinked behind the word “Web” in the listings.  If you do not wish to have your email address published, you should leave this field blank.

Copyright and Intellectual Property
By using this site, you acknowledge Thinkulus Media LLC’s copyright and intellectual property rights for all content, except any such content for which another copyright is expressly stated.  You further agree not to copy, redistribute, transfer, publish, download, “scrape”, or disseminate any content found herein without the express written consent of Thinkulus Media, LLC.  This includes any means, whether manual or automated.

PDR Junction Classifieds
By creating an advertisement in PDR Junction’s Classifieds, you give PDR Junction the right to publish that information in the Classifieds listings.  You agree to submit only good-faith advertisements with information that is true and accurate to the best of your belief and knowledge.

Participation
The above describes information that is provided “actively” – meaning, you choose to submit this information to us when you join PDR Junction, or update your account at any point after having joined. Some other information is provided “passively” – meaning, that Thinkulus Media, LLC obtains this information when you login to your PDR Junction account and use the service. This is done primarily through the use of “cookies.” Cookies are used on PDR Junction to verify your login information, and to optionally store your password in your browser so that you do not need to type it in each time you visit. Any time that you point your browser to a PDR-Insiders-only area, Thinkulus Media, LLC checks your browser’s cookie file to see if you have already logged in, and if you have, you’re taken right to the page that you have requested. If not, you’ll be directed to the PDR Junction login screen, where you can quickly and easily login to your account, or signup for a PDR Insider account if you are not yet a member. Cookies are also used in conjunction with some ad banners to determine their effectiveness.

Cookies
Thinkulus Media, LLC uses cookies to customize your experience while using our services. A cookie is a small text file that many Web sites write through your browser when you visit them. A cookie can only be read by the site that places it, so Thinkulus Media, LLC can’t learn about your browsing history based on any other cookies in your browser. Most browsers also allow the option of displaying a warning before accepting a cookie, or refusing all cookies. Declining cookies while participating in forums may result in some of features not working properly.

Advertising
PDR Junction may use third-party advertising companies and advertising networks to serve ads to you on our behalf when you visit our Web site. These companies may use information about your visits to this and other Web sites in order to provide advertisements about goods and services of interest to you. Personally identifiable information such as your name, address, email address or telephone number are not shared with advertisers without your permission. We may use personally identifiable information in order to fill in forms on third-party sites we use to present advertising offers. But this information will not be shared and will not be stored by any third parties if you decline these offers.

 

Email Communication
As a registered user, you may receive informational email messages from Thinkulus Media, LLC from time to time. All registered members are required to receive such communications. If you wish to stop these emails, you may terminate your membership at any time..

Public Forums
PDR Junction is a public forum that allows PDR Insiders to comment on certain posts and articles.  Please remember that any information that you disclose in a comment on a public forum becomes public information. You should exercise caution when deciding to disclose your personal information.

Security
The PDR Junction website has security measures in place to protect the loss, misuse and alteration of the information under its control. Thinkulus Media, LLC’s servers have strict security in place to prevent an intruder from retrieving personal information about its users.

Termination
You can elect to terminate your membership with Thinkulus Media, LLC at any time. To do so, simply send an email to pdrjunction@pdrjunction.com from the email account you used to register.  Be sure to enter the following in the subject line:  Delete My PDR Insider Account.

If you have entered a listing in the Directory of PDR Providers and would like it removed, simply contact the same address as above, using the subject line: Delete My Directory Listing.

Your Registration and User Account

The PDR Insider registration information that you provide to Thinkulus Media, LLC is considered private and personal between you and Thinkulus Media, LLC, and is governed by the foregoing Privacy Policy.  All user accounts are governed by and subject to the following rules:

    • Use of your account is expressly limited to you. Your account may not be transferred or shared with any other party, temporarily or permanently.
    • You agree to bear sole responsibility for all use of your account and for the confidentiality of your password. To protect your privacy, Thinkulus Media, LLC may suspend access or change access to your account immediately upon discovery that your account has been accessed by another person, or upon notification by you that your password has been lost, stolen or otherwise compromised.
    • You agree to provide an accurate email address. Thinkulus Media, LLC may, at its sole discretion, suspend any account that is found to contain an invalid email address. Updates to your email address are made by sending an email from the same account you used to register to pdrjunction@pdrjunction.com.  The subject line of the email should read:  Change of Email Address.  The body of the message should include your new email address.

Thinkulus Media, LLC may need to communicate with each member from time to time. As a condition of service, all active members of PDR Junction are required to receive routine and important “member service” announcements, via email, from Thinkulus Media, LLC. Member service email from Thinkulus Media, LLC may not be considered “spam” or blocked or blacklisted on any Internet blacklist service.

Rules of Online Behavior
After a new user’s first comment has been approved by moderators, Thinkulus Media, LLC does not screen or edit comments posted at PDR Junction.     However, Thinkulus Media, LLC reserves the right to monitor said comments and to remove any objectionable material at any time, at our sole discretion. By viewing and/or participating at PDR Junction, you acknowledge that you may encounter material that you find offensive.  You further acknowledge that user-contributed material such as comments and classified advertisements may or may not be truthful and/or trustworthy.  Thinkulus Media, LLC disclaims any responsibility for user-posted material.

By participating in any service of PDR Junction, you agree not to:

  1. Use services that are clearly identified as premium services unless you are a member in good standing at a subscription level that includes such services.
  2. Attach files to messages that contain viruses, corrupted files, or any other similar software or programs that may adversely affect the operation of another’s computer.
  3. Participate in such a way as to undermine the operation of PDR Junction or Thinkulus Media, LLC.
  4. Use comments to harass others.
  5. Use PDR Junction to disseminate any inappropriate, defamatory, libelous, threatening, infringing, obscene, or unlawful material or information.
  6. Violate any copyright law, or other intellectual property law.
  7. Violate any criminal statute.
  8. Engage in computer activity commonly known as a Denial of Service attack.
  9. Promote the violation of this agreement.

Thinkulus Media, LLC disclaims all liability for user-posted comments at PDR Junction. Thinkulus Media, LLC has no responsibility for such content and is merely providing access to such content as a service to you.  Use of distribution lists in electronic mail or other mass electronic mailings is subject to the approval of Thinkulus Media, LLC. Any unauthorized use of distribution lists is strictly prohibited, and may be discontinued at the sole discretion of Thinkulus Media, LLC.

By participating in PDR Junction, you agree not to impersonate any person or entity or falsely represent your affiliation with any person or entity.
Comments and Directory submissions at PDR Junction may not be used for unauthorized commercial purposes, including participation in any affiliate program. If, in the sole discretion of Thinkulus Media, LLC, you are found to be using PDR Junction for any inappropriate commercial purpose, Thinkulus Media, LLC reserves the right to take action to end said activity.

Thinkulus Media, LLC may terminate your account if it believes, in its sole discretion, that you have violated any of the terms of this agreement, or that you have engaged in any behavior that Thinkulus Media, LLC believes, in its sole discretion, is harmful to the operation of PDR Junction or to Thinkulus Media, LLC.

Privacy
Please review the PDR Junction Privacy Policy listed at the beginning of these Terms .

Thinkulus Media, LLC will strive to protect the privacy of all members who abide by these Terms of Service. However, at its sole discretion and especially in cases of abusive, libelous, illegal, and/or malicious behavior on the part of a member, Thinkulus Media, LLC may release certain membership information to appropriate parties when directed by law, through reasonable settlement of litigation against Thinkulus Media, LLC if served notice of such malicious behavior through a competent court, or for other such legitimate reasons to be determined on a case-by-case basis solely at the discretion of Thinkulus Media, LLC.

Information About Partners and Features Provided by Other Companies
Some of the features offered through PDR Junction may be operated by third party providers which may subject you to additional terms of service.  Thinkulus Media, LLC disclaims any responsibility for the operation of such services. In order to use these functions properly, these companies may need to collect or use information that you provide to them through your use of PDR Junction. In order to determine whether a) their systems are working properly, b.) any misuse or abuse of their system exists, or c) any illegal activity is occurring, these companies may have to have access to your emails, comments or other communications that occur on PDR Junction. However, Thinkulus Media, LLC is not responsible for the content or the privacy policy or practices of any other Web sites or for the actions of the companies responsible for those Web sites.

Representations, Warranties and Acknowledgments

    • Thinkulus Media, LLC does not endorse, and specifically disclaims any responsibility or liability for, any content on any user-provided message or advertisement on PDR Junction. Thinkulus Media, LLC makes no representations about the reliability of services provided by Thinkulus Media, LLC or by any third party provider, and disclaims all liability in the event of any service failure. You acknowledge that any reliance on said material and/or systems will be at your own risk.  Thinkulus Media, LLC makes no representations regarding the amount of time that user-provided content will be preserved by Thinkulus Media, LLC.
    • Thinkulus Media, LLC reserves the right to add new membership programs and to change the terms of existing membership programs at any time, including paid programs. These modifications may include, but are not limited to, changes in the service, product offerings, price, or administration of the program. Not all products are available for all platforms, clients, or browsers. Thinkulus Media, LLC will announce any change in the price of the program on its website prior to any such change taking effect.
    • By posting on creating any content (excluding private email communication), you will be deemed to have granted Thinkulus Media, LLC perpetual, non-exclusive permission to redistribute by transmission the information or materials worldwide without charge or liability.
    • You maintain a copyright on any copyrighted original material you post, to the extent allowed by law.
    • You participate in PDR Junction at your own risk. If you are dissatisfied with any feature, operability, contents, this agreement, other agreements Thinkulus Media, LLC imposes as a condition of usage, or any other component of the PDR Junction website, your sole remedy is to discontinue use of PDR Junction services.
    • If ordering merchandise and/or services from anyone other than Thinkulus Media, LLC, through any commercial service offered via an official Thinkulus Media, LLC partnership or affiliate or advertiser, via PDR Junction, all transaction terms including but not limited to purchase terms, payment terms, warranties, guarantees, maintenance, and delivery, are solely between you and the seller of the merchandise or services. Thinkulus Media, LLC makes no warranties or representations whatsoever with regard to any goods or services provided by the seller of the merchandise or services and shall not be liable for the costs or damages arising, either directly or indirectly, from the products or services or from the actions or inactions of the Seller.
    • THINKULUS MEDIA, LLC SERVICES ARE PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS. NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE MADE WITH RESPECT TO PDRJUNCTION.COM OR ANY INFORMATION OR SOFTWARE THEREIN. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THINKULUS MEDIA, LLC BE LIABLE FOR ANY INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF OR INABILITY TO USE PDR JUNCTION NOR SHALL THINKULUS MEDIA, LLC BE RESPONSIBLE FOR ANY DAMAGES WHATSOEVER THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION, OR ANY FAILURE OF PERFORMANCE WHETHER OR NOT CAUSED BY EVENTS BEYOND THINKULUS MEDIA, LLC’S REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO ACTS OF GOD, COMMUNICATIONS LINE FAILURE, THEFT, DESTRUCTION, OR UNAUTHORIZED ACCESS TO PDR JUNCTION RECORDS, PROGRAMS, OR SERVICES. IN NO EVENT SHALL THINKULUS MEDIA, LLC’S TOTAL LIABILITY FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AGGREGATE DOLLAR AMOUNT PAID UNDER THE AGREEMENT. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; AS A RESULT, THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
    • You acknowledge that Thinkulus Media, LLC has the right to delete any messages, files, or any other content that you may have uploaded to any service of Thinkulus Media, LLC which have not been accessed for some period of time and is deemed by Thinkulus Media, LLC, in its sole discretion, to be abandoned, or any materials that violate the terms of this or any other binding agreement.

Indemnification
You agree to indemnify and hold Thinkulus Media, LLC, its parents, subsidiaries, officers and employees, harmless from any claims and expenses, including reasonable attorney’s fees, related to your violation of this Agreement, including any abusive or unlawful behavior on the part of you or your dependents, or the infringement of any intellectual property or privacy right of any person.

You shall remain solely liable for the Content you upload or transmit to any Forum, blog, message board, chat room or any interactive areas on the Site. You agree to indemnify and hold harmless Thinkulus Media, LLC from any claim, action, demand, loss, expense or damages (including attorneys’ fees) made or incurred by any third party arising out of or relating to your conduct, your violation of these terms and conditions, or your violation of any rights of a third party. In the event that you have a dispute with one or more users, you release Thinkulus Media, LLC (and our officers, directors, agents, subsidiaries and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Modifications
Thinkulus Media, LLC may, at any time, modify any of the terms and conditions contained in this agreement by posting such changes on the PDR Junction web site. If you do not agree to the changes, your only remedy is to cancel your PDR Junction membership.

Governance
This Agreement will be governed by and construed in accordance with the Laws of the State of Wyoming.

Assignability
Thinkulus Media, LLC may assign this Agreement, or any rights or obligations hereunder, (by operation of law or otherwise) without the prior written consent of its members. This Agreement shall inure to the benefit of, and be binding on, permitted assigns and successors of Thinkulus Media, LLC.

Severability
In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

Amendments and Waivers
The failure of either Thinkulus Media, LLC to insist upon or enforce or to exercise any right under this Agreement shall not be construed as a waiver or relinquishment to any extent of Thinkulus Media, LLC’s right to assert or rely upon any such provision or right in that or any other instance, and the same shall be and remain in full force and effect. In the event that any published statements, other agreements, or other official policies of Thinkulus Media, LLC may conflict with any of the terms contained in this document (Terms of Service) the terms of this document shall govern.
